2. Layanan Pendanaan Bersama Berbasis Teknologi Informasi (“LPBBTI”) merupakan penyelenggaraan layanan jasa keuangan yang mempertemukan Pemberi Pinjaman dengan Penerima Pinjaman dalam melakukan pendanaan secara langsung melalui Sistem Elektronik dengan menggunakan internet.

3. Kegiatan LPBBTI tunduk dan patuh kepada seluruh ketentuan peraturan perundang-undangan yang berkaitan dengan LPBBTI.

4. RupiahCepat merupakan badan hukum Indonesia berizin dan diawasi oleh Otoritas Jasa Keuangan yang menyediakan, mengelola dan mengoperasikan LPBBTI.

5. RupiahCepat hanya dapat mengakses, memperoleh, menyimpan, mengelola, memproses, dan/atau menggunakan Data Pribadi Pengguna setelah mendapatkan persetujuan dari Pengguna.

6. RupiahCepat hanya dapat mengakses kamera, lokasi dan mikrofon pada alat komunikasi milik Pengguna.

7. Masyarakat Pengguna wajib membaca dan memahami karakteristikproduk RupiahCepat, transaksi, isi perjanjian, termasuk batas atas fasilitas Pendanaan disesuaikan dengan kemampuan Pengguna sebelum membuat keputusan sebagai Pemberi Pinjaman maupun Penerima Pinjaman. Keputusan Pengguna untuk memanfaatkan FinTech Lending merupakan suatu wujud dan bukti pemahaman Pengguna atas informasi ini.

8. Risiko Kredit atau Gagal Bayar dan seluruh kerugian dari atau terkait dengan kesepakatan pinjam meminjam ditanggung sepenuhnya oleh Pemberi Pinjaman. Tidak ada lembaga atau otoritas negara yang bertanggung jawab atas risiko gagal bayar dan kerugian tersebut. RupiahCepat bertanggung jawab dalam hal terjadi kelalaian atau kesalahan yang disebabkan oleh RupiahCepat dan menimbulkan kerugian bagi Pemberi Pinjaman.

9. Penggunaan Layanan LPBBTI atau Fintech Lending merupakan wujud kesepakatan dan hubungan perdata antara Pemberi Pinjaman dengan Penerima Pinjaman, sehingga segala risiko dan akibat hukum daripadanya ditanggung sepenuhnya oleh masing-masing pihak yang berkontrak.

10. Pemberi Pinjaman yang belum memiliki pengetahuan dan pengalaman Pinjam-Meminjam atau Fintech Lending, disarankan tidak menggunakan layanan ini.

11. Sebelum memanfaatkan Layanan LPBBTI atau Fintech Lending, Penerima Pinjaman wajib mempertimbangkan tingkat bunga pinjaman dan biaya-biaya lainnya sesuai dengan kemampuannya dalam melunasi pinjaman.

12. Setiap kecurangan tercatat secara digital di dunia maya dan dapat diketahui masyarakat luas di media sosial serta dapat menjadi alat bukti hukum yang sah menurut peraturan mengenai informasi dan transaksi elektronik dalam proses penyelesaian sengketa dan penegakan hukum.

13. Penerima Pinjaman dilarang untuk menggunakan dana pinjaman untuk melakukan tindak pidana termasuk namun tidak terbatas pada judi online, penyalahgunaan narkoba, tindak pidana terorisme, dan tindak pidana lainnya yang bertentangan dengan peraturan perundang-undangan dan hukum yang berlaku di Republik Indonesia. RupiahCepat, Pemberi Pinjaman maupun Pihak Terkait tidak akan bertanggung jawab terhadap segala hal berkaitan dengan penggunaan dana Pinjaman oleh Penerima Pinjaman dalam hal penggunaan tersebut digunakan untuk melakukan tindak pidana. Sehubungan dengan verifikasi identitas dan scoring Pengguna, data pribadi berupa KTP, NIK, nama, tanggal lahir, Swafoto, nomor ponsel dan alamat surel akan diperiksa kesesuaiannya dengan pengecekan demografi, biometrik, dan pengecekan biro kredit oleh PT Privy Identitas Digital (PRIVY) atau PT Indonesia Digital Identity (VIDA) atau PT Crif Lembaga Informasi Keuangan (CLIK) sebagai mitra kami, dengan data yang tercatat pada sistem instansi yang berhak mengeluarkan identitas terkait tersebut. Oleh karenanya, Pengguna menjamin keaslian dan keakuratan dokumen dan data pribadi yang disediakan dan setuju atas pemrosesan data pribadi tersebut untuk tujuan penerbitan sertifikat elektronik serta layanan lain yang melekat pada sertifikat elektronik yang dilakukan oleh mitra RupiahCepat. Dalam hal terjadi pemalsuan atas dokumen dan data pribadi atau tindak pidana lain yang dilakukan oleh Pengguna, RupiahCepat dapat melakukan upaya hukum termasuk pada memproses tindakan yang dimaksud kepada pihak yang berwenang. 14. RupiahCepat tidak membebankan biaya apapun kepada Pengguna atas pelayanan pengaduan.

15. RupiahCepat akan menyampaikan prosedur penyelesaian dan penagihan kepada Pemberi Pinjaman dan Penerima Pinjaman dalam hal terjadi wanprestasi Pendanaan yang dilakukan oleh Penerima Pinjaman

Rupiah Cepat Privacy Policy

This Privacy Policy provides an explanation to Users regarding the Policy of PT Kredit Utama Fintech Indonesia (“Rupiah Cepat” or “We”) related to the collection, use, storage, and disclosure of User’s (“User” or “You”) Personal Data and Information that We obtain through the Rupiah Cepat Application. Rupiah Cepat uses User’s Personal Data and Information only for the needs of developing and improving the quality of Rupiah Cepat Services or other reasonable needs and not in conflict with applicable laws and regulations in Indonesia. By providing Personal Data and Information on the Rupiah Cepat Application, Users agree to the collection and use of information as stated in the Privacy Policy for Rupiah Cepat. In using User’s Personal Data and Information, Rupiah Cepat may cooperate with other third parties while still paying attention to the confidentiality aspect of User’s Personal Data and Information.

We always prioritize the principle of confidentiality to any party above commercial interests, especially regarding your information, both related to personal information and other data in connection with the electronic loan application process in the Rupiah Cepat Application in the context of our credit verification process. We are committed to complying with applicable laws in Indonesia.

By accessing and using the Services in the Application, you acknowledge that you have read, understood and agreed to each provision in this Privacy Policy and the General Terms and Conditions of Rupiah Cepat.

  • 1. Definition

    • “You” or “User” means the party registered as a user of the Rupiah Cepat Application, either as a Loan Recipient or a Lender.
    • "Application" means (a) Rupiah Cepat mobile application created, owned and operated by Us; and/or (b) web portal and/or mobile version of web portal created, owned and operated by Us which is currently located at and accessible at the following URL: https://www.rupiahcepat.co.id/ including changes to the URL from time to time.
    • "Personal Data and Information" means all information or data, both electronic and non-electronic, from or regarding the User and/or related parties of the User (including but not limited to family, colleagues, employees, companies or others known and familiar with you who are listed as Emergency Numbers) voluntarily submitted by the User to Us, based on the User's consent which can be used to identify you directly or indirectly as an Application User, which is stored and managed by Us in connection with the provision of the Services.
    • “We” or “Rupiah Cepat” means PT Kredit Utama Fintech Indonesia which operates the trademark “Rupiah Cepat”, a financial technology company established and subject to the laws of the Republic of Indonesia, carrying out business activities as an organizer of Information Technology-Based Joint Funding Services (LPBBTI) through the Rupiah Cepat Application.
    • “Services” means various services that We offer through the Rupiah Cepat Application, especially information technology-based money lending services provided from time to time through the Application.
    • "Emergency Number" means the contact number of a party known and familiar with the Borrower listed by the Borrower when submitting a loan application through the Rupiah Cepat Application as a party that can be contacted by Rupiah Cepat for the purposes as stipulated in "Use of Emergency Numbers".
    • "Lender" means a party registered in the Rupiah Cepat Application to provide funding in the form of providing and distributing Loans to Borrowers through the Rupiah Cepat Application.
    • "Loan Recipient" means a party registered in the Rupiah Cepat Application to receive funding in the form of loans from the Lender through the Rupiah Cepat Application.
    • "Loan Agreement" means an agreement between the Lender, Rupiah Cepat, and the Borrower which regulates, among other things, the rights and obligations of the Lender and Borrower, the terms and conditions for the distribution of Loans from the Lender through Rupiah Cepat to the Borrower, and the procedures for repayment or payment of Loans along with changes, extensions, and attachments.
    • “Funding Agreement” means an agreement between the Lender and Rupiah Cepat that regulates the distribution of loan funds from the Lender to the Borrower through Rupiah Cepat.
    • “Loan” means a loan facility (including interest, fines and other financial obligations) from the Lender that is distributed by the Lender to the Borrower through the Rupiah Cepat Application based on the Loan Agreement.
    • “General Terms and Conditions” means the terms and conditions or standard operating procedures or other provisions in connection with the Application developed by Us, as may be amended or supplemented from time to time.
  • 2. Collection of Personal Data and Information

    We collect information that identifies or can be used to identify, contact, or locate the person or device associated with such information ("Personal Data and Information"). Personal Data and Information includes, but is not limited to, name, address, date of birth, occupation, telephone number, e-mail address, bank account, gender, identity documents (including KTP, SIM, Passport, or NPWP) or other government-issued identification, photo, nationality, telephone number of the User and related parties of the User (including but not limited to Emergency Numbers or other contacts provided by the User through Our Application), related financial information (including but not limited to income information, source of funds), and biometric information (including but not limited to facial recognition). In addition, for other information, such as personal profiles, and/or unique identification numbers, which are associated or combined with Personal Data and Information, then such information is also considered Personal Data and Information. The Personal Data and Information that We collect may be provided by You directly or by a third party (for example: when You register or use the Application, when You contact Our Customer Service, or otherwise when You provide Personal Data and Information to Us). We will collect the Personal Data and Information that you provide through the Application including but not limited to KTP Data and Information, account number, telephone number, source of funds, social media, and other data that you provide in the Application. Your Personal Data and Information will be used for funding and lending purposes in the Application which includes the verification process, credit score assessment, anti-money laundering and terrorism financing risk assessment, and the collection process. As for processing your Personal Data and Information, we cooperate with third parties in accordance with laws and regulations and guarantee the confidentiality of your Personal Data and Information will only be used in accordance with the purpose of processing Personal Data and Information. The parties that cooperate with us to process your Personal Data and Information are credit score assessment companies, collection service providers, including but not limited to the Social Security Administration Agency and e-commerce services. We will continue to store your Personal Data as long as you are still using the Rupiah Cepat Application or you do not close your account or other matters regulated in Law Number 27 of 2022 concerning Personal Data Protection.

    Information We collect from you or your mobile device directly

    When you register and create an account on the Application, you must provide Us with Personal Data and Information including name, address, date of birth, occupation, telephone number, e-mail address, bank account, gender, identity documents (including KTP, SIM, Passport, or NPWP) or other government-issued identification, photo, nationality, telephone number of the User and related parties of the User (including but not limited to emergency contacts or other contacts provided by the User through Our Application), related financial information (including but not limited to income information, source of funds), and biometric information (including but not limited to facial recognition).

    When you use the Application, you must provide Us with relevant information that may be required by Us for the Application to function, for example:

    • 1. If you use the Application as a User, you must give Us consent to access your camera (to identify you), microphone (for your telephone conversations with Us which are fully monitored and recorded in Our system), and GPS (to determine your approximate location).
    • 2. If you use and/or when making payments or transfers through payment gateway facilities provided by and/or in collaboration with Us, if you are the payer or sender, you will provide Us with information relating to the use, payment or transfer, including but not limited to transfer details, amount of payment paid, bank name, account holder name, account number, as applicable.

    Information collected whenever you use the Application or visit Our website

    Whenever you use the Application or visit Our website, We may collect certain technical data in connection with your usage such as, internet protocol address, duration of each visit/session, internet device identifier, and other device information including information about the manufacturer, model, and operating system of the device you use to access the Application or Our website.

    When you use the Application or visit Our website, certain information may also be collected automatically using cookies. Cookies are small data files stored on your computer or mobile device. We use cookies to track user activity in order to improve the user interface and experience. Most mobile devices and internet browsers support the use of cookies; however, you can adjust the settings on your mobile device or internet browser to refuse certain types of cookies or certain specific cookies. Your mobile device and/or browser also allows you to delete any cookies that have previously been stored. However, this may affect the functionality available on Our Application or website.

    Every time you use the Application via a mobile device, We can know your geographic location in real time. You will be asked or required to activate the Global Positioning System (GPS) on your mobile device to enable Us to provide Services through the Rupiah Cepat Application (including but not limited to for the purposes of credit risk assessment and fraud prevention). We will not access your precise location. You can temporarily disable geographic location tracking information on your mobile device. However, this may affect the functions available on the Application.

    If you use and/or when making payments or transfers through payment gateway facilities provided by and/or in collaboration with Us, We may collect certain information relating to the use, payment or transfer, including but not limited to transfer details, amount of payment paid, payment settlement details, bank name, account holder name, account number, as applicable.

    Information collected from third parties

    We may also collect your Personal Data and Information from third parties (including agents, vendors, suppliers, contractors, partners and others who provide Services to Us, collect Personal Data and Information and/or perform tasks on Our behalf, or with whom We collaborate). In such cases, We will only collect your Personal Data and Information for or in connection with the purposes for which such third parties are involved or for the purposes for which We collaborate with such third parties (e.g. to collect certain financial information such as credit history, or other data that may result in your eligibility to receive Our Services, as the case may be).

    Information about third parties that you provide to Us

    You may provide Us with Personal Data and Information relating to any related parties of the User (including but not limited to family, colleagues, employees, employers or others listed as emergency contacts). You will of course need their prior consent to do so - see “Acknowledgement and Consent”, below, for more information.

  • 3. Use of Personal Data and Information

    We may use your personal data and information for:

    • 1. to identify and register you as a user and to administer, verify, deactivate or manage your account;
    • 2. to facilitate or enable any verification that We deem necessary before We provide the Services to you or before We register you as a User, including conducting Know Your Customer (KYC) processes and credit scoring;
    • 3. to carry out assessment, analysis, verification, validation or examination of your application for registration as a User (Lender or Borrower), loan application and/or your profile;
    • 4. to conduct risk assessments, statistical and trend analysis and planning, including carrying out data processing, statistical analysis, credit, risk and anti-money laundering, counter-terrorism financing, creating and managing credit scoring models, conducting credit and other background checks and reviews, and storing your credit history for current and future reference;
    • 5. managing Our relationship with You which may include providing You with information about Us and enabling You to use the Services provided by Us;
    • 6. send notifications via telephone number, e-mail, or Application to you;
    • 7. contact you regarding your requests and provide assistance in connection with and to resolve complaints, technical difficulties or operational issues with the Application or Services and stored to prevent fraud;
    • 8. prevent and detect fraudulent activities, including but not limited to the use of voice detection technology to analyze recordings of your telephone conversations with Us, as well as any prohibited, illegal, unauthorized or fraudulent activities;
    • 9. for our general business purposes, for example to verify your identity and your credit standing;
    • 10. identify you when you contact Us or visit the Application.
    • 11. send marketing (advertisements, vouchers, surveys, information about special offers or promotions) and non-marketing commercial communications to you and offer or provide Services from Our affiliates or partners; to generate statistical information and analytical data for the purposes of testing, research, analysis, product development, commercial partnerships and cooperation.
    • 12. provide sufficient information in the Application to identify you to the Lender and/or Borrower;
    • 13. allow you to participate in Our interactive features Services;
    • 14. allow banks, financial institutions or authorized third parties (including but not limited to FDC, Pusdafil, and SLIK) to conduct limited checks on your status in our database or the Service;
    • 15. verify your compliance with the terms and conditions governing your use of the Application;
    • 16. generate statistical information and analytical data, surveys, research, evaluation and/or development of products or services by Us or related parties in order to improve performance efficiency, development, user experience, Application functions, commercial partnerships, cooperation and related business function processes;
    • 17. managing the User's escrow account with the escrow account provider;
    • 18. conducting anti-money laundering and prevention of terrorism financing checks in the financial services sector;
    • 19. fulfill and implement government orders or policies, legal requirements, regulations and compliance applicable to Us based on applicable laws and regulations and comply with any applicable agreements in connection with the implementation of the Services;
    • 20. to notify you of transactions or activities occurring within the Application or other systems connected to Our Application;
    • 21. to notify you of any updates to the Application or changes to the Services provided;
    • 22. to process and respond to questions and suggestions received from you;
    • 23. monitor and analyze user activities, behavior and demographic data including habits and use of various Services available on the Application to maintain, develop, test, improve and personalize the Application to meet your needs and preferences as a user;
    • 24. to process and manage your reward points;
    • 25. to facilitate business asset transactions (which may be mergers, acquisitions or asset sales) involving Us and/or Our affiliates; and
    • 26. to enable Us to comply with all obligations under applicable laws and regulations, including but not limited to responding to regulatory requests, inquiries or directives, complying with applicable regulatory filing, reporting and licensing requirements) and conducting audits, due diligence and investigations.
  • 4. Disclosure of Personal Data and Information

    We may disclose, provide access to, or share your Personal Data and Information with our affiliates and other parties for the following purposes, as well as for other purposes permitted by applicable laws and regulations:


    • 1. to enable the provision of Services to you as a User;
    • 2. if required or authorized by applicable laws and regulations (including but not limited to responding to regulatory inquiries, investigations or guidelines, or complying with statutory filing and reporting requirements or provisions), for the purposes specified in applicable laws and regulations;
    • 3. if instructed, requested, required or permitted by the competent government, for purposes as stated in applicable government policies, regulations or laws;
    • 4. if there is any legal process in any form between you and us, or between you and another party, in connection with, or related to the Services, for the purposes of such legal process;
    • 5. in connection with any verification process We or third parties require before providing Services to you by Us or Our partners, or Us registering you as a user, including the Know Your Customer (KYC) process and credit scoring;
    • 6. when Our Services are available on third party platforms, (i) to help Us obtain Your Personal Data and Information and/or (ii) to register You or help You use Our Services on such third party platforms;
    • 7. in connection with, a merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or a portion of Our business by or into another company, for the purposes of such transaction (even if the transaction is not subsequently consummated);
    • 8. in connection with the insurance claim process, We will share Your Personal Data and Information for the purpose of processing insurance claims with insurance companies that cooperate or collaborate with Us;
    • 9. to third parties (including agents, vendors, suppliers, contractors, partners and other parties who provide Services to Us or You, perform tasks on Our behalf, or parties with whom We have a commercial relationship), for or in connection with the purposes for which such third parties are involved, including, among others, general insurance, banking, payment service providers, third party billing services, digital signature providers, electronic messaging service providers (including SMS and OTP), credit rating service providers, data centre providers and other companies that cooperate with Us in Our business processes, or for the purposes of Our cooperation with such third parties (as the case may be), which may include allowing such third parties to introduce or offer products or Services to You, authenticate You or connect You to an account or carry out other activities including marketing, research, analysis and product development; and
    • 10. In the event that We share Personal Data and Information with affiliates, We will do so for the purpose of them assisting Us in providing the Application, to operate Our business (including, if You subscribe to Our mailing list, for direct marketing purposes), or for the purposes of processing data on Our behalf. All of Our affiliates are committed to processing the Personal Data and Information they receive from Us in accordance with this Privacy Policy and applicable laws and regulations.
    • 11. When Personal Data and Information need not be associated with you, We will make reasonable efforts to de-associate such Personal Data and Information with you before disclosing or sharing such information.
    • 12. We will not sell or rent your Personal Data and Information.
    • 13. In addition to what is set out in this Privacy Policy, we may disclose and share your Personal Data and Information if we notify you and we have obtained your consent for such disclosure or sharing.
  • 5. Security and Storage of Personal Data and Information

    Your Personal Data and Information in accordance with this Privacy Policy are stored securely in the territory of the Republic of Indonesia. Your Personal Data and Information will be stored by Us for a minimum period of 5 (five) years or as long as such storage is required or permitted under applicable laws and regulations.

    We will stop storing Personal Data and Information, or remove the purpose of associating such Personal Data and Information with you, as soon as it is deemed that the purpose of collecting such Personal Data and Information is no longer needed by storing Personal Data and Information and storage is no longer necessary for business purposes or legally.

    Please note that there is still a possibility that some of your Personal Data and Information are stored by other parties including government institutions or other institutions appointed by the authorized government in a certain way. In the event that We share Your Personal Data and Information with authorized government institutions and/or other institutions that may be appointed by the authorized government or have cooperation with Us, You agree and acknowledge that the storage of Your Personal Data and Information by the relevant institutions will follow the data storage policies of each such institution.

    The security of your Data and Personal Information is very important to Rupiah Cepat. Rupiah Cepat always takes reasonable steps and actions to prevent the loss, misuse, or unauthorized changes to your Data and Personal Information by unauthorized parties. Our security system has met industry standards and We always monitor technological and industrial developments to ensure that Our system develops as required. We also test Our system periodically to ensure that Our security mechanisms are always up to date.

    However, please note that there is no method related to data transmission over the internet, or electronic storage method that is 100% (one hundred percent) secure. Therefore, you are also asked to maintain the confidentiality of your personal data, by creating a personal password or OTP code when registering and when using the Application. You are responsible for maintaining the confidentiality of the password and OTP code and are advised not to share your password and OTP code with any party.

    We are not responsible for any losses incurred due to your negligence or error related to the storage and use of Your Data and Personal Information on Our Application.

  • 6. Changes to Personal Data and Information

    Subject to applicable laws and regulations, you may make changes to your Personal Data and Information through the Application or other means in accordance with Rupiah Cepat's data change policy.

    We have the right to reject your request to correct or change some or all of your Personal Data and Information that We have or control if permitted or required under applicable laws. This includes circumstances where such Personal Data and Information may contain references to unauthorized persons or where the request to correct or change such Personal Data and Information is for reasons that We deem irrelevant, frivolous, or troublesome.

  • 7. Deletion of Personal Data and Information

    You have the right to and can submit a request for deletion of your Personal Data and Information that has been provided to Us with the following requirements:

    • 1. not currently bound by an agreement in connection with the provision of Services by Rupiah Cepat, either a Loan Agreement or a Funding Agreement; or
    • 2. have no rights in connection with the provision of Services on the Application, including but not limited to the right to claim returns, repayment and settlement of receivables; or
    • 3. have no obligations, financial responsibilities, debts or similar matters in connection with the provision of Services by Rupiah Cepat; or
    • 4. not in the process of submitting a loan application, including the verification and assessment process of the application by Us; or
    • 5. submit an account closure request.
  • 8. Use of Emergency Numbers

    The purpose of contacting the Emergency Contact is to confirm the whereabouts of the Loan Recipient if the Loan Recipient cannot be contacted. The use of the Emergency Contact is limited and is not intended to collect debts from the owner of the Emergency Contact data.

    The Loan Recipient states and guarantees that the Loan Recipient has listed and/or provided an emergency contact number independently to RupiahCepat. RupiahCepat will confirm and attempt to obtain approval from the owner of the emergency contact data and document it in accordance with applicable laws and regulations. The emergency contact number will be used for the purpose of confirming the whereabouts of the Loan Recipient if the Loan Recipient cannot be contacted. RupiahCepat will not use the emergency contact number for collection purposes or other actions that violate applicable laws and regulations.

    RupiahCepat may contact the emergency contact number for the above purposes using personal communication means (as determined by Us from time to time). In contacting the emergency contact number, We avoid any form of intimidation, threats and/or other violations of the law.

    In the event of any loss or lawsuit arising from the listing of the emergency contact number by the Borrower, the Borrower agrees to release and provide compensation to RupiahCepat, as long as RupiahCepat has fulfilled its obligations in accordance with applicable provisions.

  • 9. Waiver of Liability

    You agree not to hold Us liable for any breach, violation or non-compliance with the Privacy Policy or the protection of Personal Data and Information in the following situations:

    • 1. where an act of nature or unforeseen circumstances has occurred, resulting in damage, destruction or destruction of equipment and/or machinery used to secure, store or process User Data and Personal Information;
    • 2. where Personal Data and Information has been available or can be found by the public before the Personal Data and Information or such information is submitted to Us;
    • 3. where after every reasonable effort and attempt has been made by Us to verify, secure and protect your personal data and information, there is unauthorized access, hacking, misuse, modification, alteration, interference, as long as it can be proven that this is not caused by Our fault or negligence;
    • 4. for the accuracy (except for Personal Data and Information that has been verified by Us in accordance with Our policy), validity, legality and completeness of Your Personal Data and Information and is not required to notify You or any party regarding this matter unless required by law; and/or
    • 5. where misuse of Personal Data and Information is caused by criminal acts, fraud or any criminal offence or the actions of third parties not under Our control or instructions.

    We will make reasonable efforts to notify you if there is a failure to protect the confidentiality of your Data and Personal Information in our management, whether caused by us or when we learn about it from a third party managed with the following notification provisions:

    • 1. by including the reasons or causes for the failure to protect the confidentiality of Personal Data and Information;
    • 2. written notification via e-mail to you no later than 14 (fourteen) days after becoming aware of the failure;
    • 3. provide easy-to-contact contacts for you regarding the management of Personal Data and Information.
  • 10. Media Social Access

    You may (but are not required to) connect your Rupiah Cepat account with your social media account in order to provide the Service and to improve your credit score. We only use the data and information resulting from the connection of the social media account for the following purposes:

    a. identity verification;
    b. mitigating the risk of identity fraud;
    c. statistical analysis/quantitative;
    d. conducting regulatory control;
    e. preventing fraud, money laundering and other criminal activities.
  • 11. Anonymous Data

    We may create, use, license or disclose Personal Information, provided that (i) all identifiable information has been removed so that the data, either alone or in combination with other available data, cannot be associated with or linked to or cannot identify an individual, and (ii) similar data has been combined so that the original data forms part of a larger data set.

  • 12. Privacy Policy Changes

    We may review and amend this Privacy Policy in Our sole discretion from time to time, to ensure that this Privacy Policy is consistent with Our future developments, and/or changes in applicable legal or regulatory requirements. If We change this Privacy Policy, We will notify You of such changes by means of a general notice published on Our Application and/or website. You agree that You are responsible for reviewing this Privacy Policy periodically for the latest information on Our data processing and data protection practices, and that Your continued use of Our Application or website, or access to and use of the Services following any changes to this Privacy Policy will constitute Your acceptance of this Privacy Policy and any changes.

    By using the Application, you acknowledge that you have read, understood, and agreed to this Privacy Policy and the General Terms and Conditions, and agree and consent to the collection, use, disclosure, storage, processing, and transfer of your Personal Data and Information by Us as stated in this Privacy Policy.

    In circumstances where you provide Us with Personal Data and Information relating to related parties of the User (including but not limited to family, colleagues, employees, companies or others known and familiar with you who are listed as Emergency Numbers), you represent and warrant that you have obtained the consent of such parties to - see “Use of Emergency Numbers”, above, for more information.

    You may withdraw your consent for any or all collection, use or disclosure of your Personal Data and Information at any time by providing Us with reasonable notice in writing using the contact details set out below. Depending on the circumstances and nature of the consent you withdraw, you must understand and acknowledge that upon withdrawal of such consent, you may no longer be able to use the Application or Services. Withdrawal of your consent may result in the termination of your account or your contractual relationship with Us, with all rights and obligations arising therefrom to be fully complied with. Upon receipt of notice to withdraw consent for the collection, use or disclosure of your Personal Information, We will inform you of the possible consequences of such withdrawal so that you can decide whether you still wish to withdraw your consent.

  • 14. Marketing and Promotional Materials

    We and our partners may send you direct marketing, advertising and promotional communications via push notifications, in-app messages, post, phone calls, Short Message Service (SMS), chat platforms, social media and email if you have consented to use our App and/or agreed to receive marketing and promotional materials from us. You may opt out of receiving such marketing communications at any time by contacting us using the contact details set out below. Please note that if you opt out, we may still send you non-promotional messages, such as receipts or information about your account.

  • 15. Merger

    In addition to this Privacy Policy, the following also apply to the use of the Rupiah Cepat Application Services and are considered as one entity:

    1. General Terms and Conditions;
    2. Terms and conditions in the Loan Agreement and Funding Agreement;
    3. Other agreements with Us that will govern your use of the Services.
  • 16. Applicable Law and Dispute Resolution

    • 1. This Privacy Policy is governed by and subject to the laws of the Republic of Indonesia. The parties agree that any disputes or disputes arising from or related to this Privacy Policy will first be resolved through deliberation to reach a consensus. Deliberation efforts must be made by the Parties within a maximum period of 30 (thirty) calendar days from the date one party provides written notification to the other party regarding the existence of a dispute or dispute. If within that period the parties do not reach an agreement, then the dispute or dispute is deemed to have failed to be resolved through deliberation.
    • 2. If efforts to reach a consensus fail to be resolved as referred to in paragraph (1), then the Parties agree to resolve the dispute or disagreement through the Alternative Dispute Resolution Institution (LAPS) in the Financial Services sector in accordance with the provisions of the applicable Financial Services Authority Regulations (POJK).
